Referral Partner Agreement

1. Purpose
This Referral Partner Agreement applies to OMVA users who create, operate, publish, market, or monetise an OMVA-powered site.
2. Your role
You are a referral partner/site owner. You are not an insurer, broker, underwriter, claims handler, financial adviser, insurance adviser, or representative of OMVA or any insurer unless separately authorised by law and approved by OMVA in writing.
3. No advice
You must not provide:
- personalised financial advice
- personalised insurance advice
- product recommendations based on a customer's personal circumstances
- underwriting decisions
- claims advice
- statements that a product is suitable for a specific customer
- statements that a customer is guaranteed to be accepted, save money, or receive cover
4. Marketing obligations
You are responsible for all marketing you conduct, including paid ads, organic posts, influencer campaigns, email, SMS, SEO, landing pages, social media, domains, and offline promotion.
You must not:
- spam people
- buy fake traffic or fake leads
- generate fake referrals
- self-refer to earn commissions
- mislead customers
- use insurer or regulator logos without permission or lawful basis
- claim licensing, awards, approval, savings, or insurer relationships unless verified and authorised
- imply OMVA or your site is an insurer or adviser
5. Site content
You are responsible for your site content, including AI-generated drafts, template edits, custom pages, logos, CTAs, testimonials, claims, and ads.
OMVA may scan, moderate, remove, edit, reject, unpublish, or suspend content that creates legal, regulatory, privacy, brand, or customer-risk issues.
6. Customer data
You must not attempt to access, scrape, export, infer, reconstruct, or request customer personal information unless OMVA expressly enables a lawful feature and you are authorised.
OMVA may provide you with aggregated/non-PII metrics such as traffic, referral counts, conversion rates, commission amounts, performance, and product categories.
7. Commission eligibility
Commissions are only payable when all eligibility rules are met. Eligibility may depend on:
- valid referral tracking
- customer eligibility
- insurer/provider approval
- policy activation or retention
- plan level
- fraud/compliance review
- no self-referral or prohibited conduct
- no cancellation, reversal, chargeback, policy lapse, or invalid traffic
- payout provider availability
8. No guaranteed earnings
OMVA does not guarantee traffic, conversions, commission, renewals, payouts, profit, income, or financial success. Example earnings, estimates, dashboards, or projections are not guarantees.
9. Renewals
Renewal/recurring commissions may be available for some products or providers, but are not guaranteed. They may stop, be delayed, be reversed, or change based on insurer/provider rules, customer retention, cancellation, payment, fraud review, or OMVA plan terms.
10. Taxes
You are responsible for taxes, GST/VAT, income reporting, invoices, records, and legal obligations arising from your OMVA activity, unless OMVA is legally required to handle a specific tax obligation.
11. Suspension and termination
OMVA may withhold commissions, suspend your site, block payouts, terminate this agreement, or remove you from the platform if you breach this agreement or create legal/compliance risk.
